PRESS RELEASE FROM THE CSSA -

CSSA RESPONDS TO GOVERNMENT CALL FOR EVIDENCE ON THE EFFECTIVENESS OF TUPE REGULATIONS

The CSSA today responded the Government’s call for evidence on the effectiveness of the Transfer of Undertakings (Protection of Employment) – TUPE regulations as part of its employment review with members supplying their practical experiences of operating within the TUPE regulations.

Andrew Large, Chief Executive of the CSSA commented that “we are pleased to have the opportunity to respond to this consultation as the current TUPE regulations as they are currently drafted presents major impediments for cleaning companies generating new business by tendering for new contracts”.

The CSSA in its response cited important issues such as the full burden of employment liability falling squarely on the transferee employer even though the European Business Transfers Directive from which the regulations originate allows for the liability to be jointly shared. It was also noted in the response that another major concern of CSSA members was their difficulty in obtain reliable and timely information on employment liability with many of them discouraged from seeking remedies from organisations who fail to fulfil their obligations in this regard.

Andrew Large commented “it is important that the Government recognise that the transfer of the provision of services is an essential component of the contract cleaning industry and that the TUPE regulations make it difficult for many contractors from undertaking this essential endeavour. We hope that if the Government wishes to introduce reforms that allow UK businesses to thrive in these challenging economic times that they take into account the experiences and insights our members have supplied on the TUPE regulations.
